The whole "dirivative works become property of Nintendo" deal somwhere in there. It has been a while since I read it, but I distinctly remember something to that effect being inside of it, in the section that dealt with homebrew stuff.. the Wii TOS is huge anyway.

There is an Open Source Dev kit developed by the The fine people at www.Wiibrew.org so ALL homebrew on the wii is 100% Legal with NO Nintendo Binarys whatsoever! There is nothing stopping anyone from porting Stepmaina to the wii...

Nothing like the situation with the xbox scene.... because the Nintendo Dev Kit is NOT used where as the xbox one was...(although it was unnecessary to use since there were open source kits for that too.)

Onilink, you have a slight error in your logic: If you use a legit devkit, you will have payed and set up a production license with nintendo, wherin you retain your rights.
You are correct on everything else, and the above guy is quite incorrect in the legality of such things.
If it's not 1st party, and not licensed thru nintendo, it is, by deffinition and TOS license, illegal, and fits under what I call the "ownership clause" of the Wii TOS.
